Music, hi guys. In today's video, I am going to discuss how to write an affidavit or the format of an affidavit. So, let's start with Rule 1 of CPC 1908. Rule 1 talks about the affidavit and states that any court may, at any time for sufficient reason, order that a particular set or sets may be proved by affidavit, or that the affidavit of any witness may be read at the hearing, on such conditions as the court deems reasonable. According to this rule, if the court has sufficient reason, it can allow the admission of evidence that should be proved by affidavit at its discretion. An affidavit is mostly used in court proceedings to talk about the facts relevant to the case. It should start with a short introduction, including the name of the court, the place of the court, and the matter of the case (e.g., "In the matter of A and B"). Then, you need to mention the suit number of the case (e.g., 2017 suit number). I have discussed the importance of suit numbers in my previous videos. After that, you should mention the subject of the suit, such as recovery of property or recovery of money. It is important to state the subject clearly so that the court can determine if it has jurisdiction or not. Next, you need to mention that the affidavit is filed on behalf of a particular party. For example, if it is filed on behalf of the plaintiff, you have to write "Affidavit on behalf of the plaintiff." Once the introduction is completed, you can start with the content of the affidavit. First, you should mention the name of the person filing the affidavit, his/her father's name, age, and residence. This is just an introductory statement to provide information...
